Terms of Use

These terms govern your use of Sparky QC (“Sparky QC”, “we”), available at sparkyqc.com. By creating an account or using the service you agree to them.

1. What Sparky QC is

Sparky QC is document control software for electrical contractors. It stores your project records, cross-references them against each other, and compiles them into a printable turnover job book.

2. What Sparky QC is not

Sparky QC does not make your project compliant, and does not certify, approve, or verify anything.

It organises, tracks, and compiles records. Whether the work meets code is determined by your procedures, your qualified personnel, and the governing specification — not by software.
The Audit tab and any cross-checks are aids, not approvals. They surface inconsistencies we know how to look for. They do not and cannot confirm a package is complete or correct, and an empty audit result is not a statement that your project is compliant.
AI document reading extracts values for you to check. It does not verify a certificate is valid, current, or genuine. You confirm every value before it is saved. That judgement belongs to a qualified person, and a QA/QC record is a legal document.
You remain solely responsible for the accuracy, completeness, and compliance of your records and your work.

3. Your account

You must be 18 or over and able to enter a contract. You are responsible for keeping your password secure and for everything done under your account. Tell us promptly at support@sparkyqc.com if you believe it has been compromised.

One account is for one person. Sharing a login is not a substitute for buying a seat.

4. Acceptable use

Do not use Sparky QC to store unlawful content; attempt to access another customer’s data; probe, scan, or attempt to defeat our security; reverse engineer the service; resell or white-label it without a written agreement; or upload malware.

We may suspend an account that puts the service or other customers at risk. Where practical we will tell you first.

5. Your content is yours

You own your project records, drawings, certificates, photographs, and everything else you put into Sparky QC. We claim no ownership of it.

You grant us only the licence we need to run the service: to store, process, back up, and display your content to you and to those you invite, and to transmit it to the providers listed in our Privacy Policy for that purpose.

We access your content only to operate the service, provide support you have asked for, and keep it secure. We do not use it for marketing, and we do not use it to train AI models.

6. Subscriptions, trials, and billing

Free trial. New accounts start with a 14-day trial. No card is required, and a trial never converts into a paid subscription on its own. You pay only if you choose to subscribe.
Subscriptions are billed monthly per user seat and renew automatically until cancelled.
Seats are counted from accepted members. Pending invitations are never charged, and read-only auditor seats are free however many you invite. Adding or removing a member is prorated at the next cycle.
Cancellation takes effect at the end of the period you have already paid for. You keep full access until then and are not charged again.
Refunds are set out in our Refund and Cancellation Policy, which forms part of these terms.
Payments are processed by Stripe. We never receive or store your card details.
Price changes will be notified by email at least 30 days before they take effect on your account.

7. AI document credits

AI document reading is sold as prepaid credits, separately from your subscription.

Credits are a one-time purchase, not a subscription, and do not expire.
One credit is spent per document read. If a read fails, the credit is returned automatically.
Unused credits are not refundable for cash, but remain on your account.

8. Availability

We aim to keep Sparky QC available continuously but do not guarantee uninterrupted service. Maintenance, provider outages, and faults happen. We do not currently offer a contractual uptime commitment; if you need one, contact us about enterprise terms.

Keep your own copies. Save Snapshot on the Project Turnover tab downloads a complete copy of a project that is yours outright and independent of us. We recommend taking one at project milestones. This is sensible practice with any hosted service, ours included.

9. Your data if you stop paying

Nothing is deleted when your subscription ends. Your account becomes read-only for 90 days: you can sign in, read everything, print job books, export CSVs, and download attachments. We also email you a complete export automatically when your subscription ends.

After 90 days your data may be permanently deleted. If you resubscribe before then, everything is where you left it.

10. Warranties

Sparky QC is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be error-free, that it will identify every inconsistency in your records, or that your turnover package will be accepted by any client, auditor, or authority.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost business, project delay, rework, remediation, or regulatory penalties, arising from your use of Sparky QC.

Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

Nothing here excludes liability that cannot lawfully be excluded.

12. Indemnity

You agree to indemnify us against claims arising from your content, your use of the service in breach of these terms, or your violation of law or the rights of others.

13. Termination

You may cancel at any time from Billing. We may suspend or terminate an account for material breach of these terms, non-payment, or conduct that puts the service or other customers at risk. Section 9 governs your data after termination.

14. Changes to these terms

We may update these terms. If a change is material we will email account holders and update the date above before it takes effect. Continuing to use Sparky QC after that date means the updated terms apply. If you do not agree, you may cancel before then.

15. Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict of law rules. Any dispute arising from them will be brought in the state or federal courts located in Texas, and both parties consent to the jurisdiction of those courts.
